
I, for one, am thankful for the Trump administration’s successful effort to overturn Roe V. Wade. But as we anti-abortionists have said all along, that was only the start of the battle to end abortion.
Abortion regulations were ended on the federal level, and power was transferred back to the states. Many states, in response, automatically triggered pro-life protections. But as Family Research Council President Tony Perkins recently pointed out in June, these laws are being actively and almost entirely circumvented by mailing abortion pills to women, often over state lines.
“A policy change by the FDA under the Biden administration permitted abortion inducing drugs to be mailed into these pro-life states without any medical oversight,” Perkins explained. “Now, that change not only endangers women, but blatantly violates duly enacted state laws. That policy remains in place to this very day.”
These loopholes have been so heavily exploited that abortion by mail is now the leading cause of abortion in the United States. But by God’s grace, a landmark lawsuit filed in July has the potential to change that.
Last month, Jerry Rodriguez filed a wrongful death lawsuit against a California abortion doctor after he mailed Rodriguez’s girlfriend abortion pills across state lines into Texas.
In the suit, Rodriguez’s attorney explains that he began dating his girlfriend, Kendal Garza, in June of 2024. By July, she had become pregnant with his child, much to the chagrin of Garza’s estranged husband, Adam Garza. Fast forward to September, and Mr. Garza ordered abortion pills by Venmoing Dr. Remy Coeytaux $150 with the description “Aed axes Kendal Garza,” allegedly code for “aid access” a nonprofit that ships abortion drugs to places where it is outlawed.
“Under the law of Texas, a person who assists a pregnant woman in obtaining a self-managed abortion commits the crime of murder and can be sued for wrongful death,” the lawsuit states, adding that “it is also a state jail felony for anyone other than a Texas-licensed physician to provide an abortion-inducing drug for the purpose of inducing an abortion.”
In violation of these and many other laws, the defendant, Dr. Remy Coeytaux, mailed abortion inducing drugs into Texas that were used to murder Jerry Rodriguez’s unborn child.
As far as damages go, Rodriguez is seeking more than $75,000, along with a permanent injunction to stop Dr. Coeytaux from illegally mailing abortion pills ever again. Most importantly, Rodriguez and his legal team want to establish precedent, making all fathers of unborn children, whether current or future, a protected class of plaintiffs, should this ever happen again.
If this lawsuit is successful, the precedent it could set cannot be overstated.
Many blue states, including California, have enacted measures to protect abortion doctors’ ability to treat patients across state lines. The key to this lawsuit is that it’s a civil suit filed in federal court, which some legal scholars, as reported by Fox News, suggest could provide a legal loophole for plaintiffs like Rodriguez to target abortionists across state lines.
At the end of the day, all of these loopholes and “legalese” would not even be a topic of discussion if our country had any spiritual and moral clarity. A new human life is formed at conception. To take an innocent life in any way, shape, or form violates God’s lawโ“thou shalt not murder” (Exodus 20:13, Deuteronomy 5:17, Matthew 5:21).
