Texas’ Battle To Protect Children From Pornography Arrives At The Supreme Court

On Jan. 15, the Supreme Court heard oral arguments on whether Texas can continue enforcing age restriction requirements for pornography websites.

Texas House Bill 1181, enacted in June 2023 by a 164-1 vote, states that “A commercial entity that knowingly and intentionally publishes or distributes material on an Internet website, including a social media platform, more than one-third of which is sexual material harmful to minors, shall use reasonable age verification methods … to verify that an individual attempting to access the material is 18 years of age or older.”

Before the law went into effect, the Free Speech Coalition, a trade association of the pornography industry, filed suit against Texas, arguing the bill violated freedom of speech and users’ privacy rights. The law’s implementation was blocked by a federal district court in Texas until the 5th Circuit Court of Appeals overturned the injunction. But the bill’s mandate for pornography businesses to include warning labels such as “potentially biologically addictive” and “proven to harm brain development” did not stand.

The case Free Speech Coalition v. Paxton went to the Supreme Court on Wednesday. Some court observers believe the justices are poised to rule in the state’s favor. Texas’s legal team has argued that pornography harms children, citing statistics regarding the behavior and psychological harm children who view pornography experience. The state also stated that over half of children report they have viewed pornography by age 13, which, they said, shows a lack of adequate safeguards on such material.

Meg Kilgannon, senior fellow at the Family Research Council, spoke at a rally hosted by the American Principles Project before the hearing.

“The protection of children is a value shared by all civilized people,” Kilgannon said. “America needs to stop worrying about the ‘market access’ of corporations who want to profit off the exploitation of women and children. Americans need to stop listening to people who think that monetizing vice is a noble constitutional cause.”

The National Center on Sexual Exploitation filed an amicus brief supporting the law. Peter Gentala, the center’s senior legal counsel, gave a hopeful statement for Texas in the brief.

“There was broad consensus in the courtroom today that pornography is harmful to children and communities should have the ability to take reasonable steps to prevent children from accessing pornography,” Gentala said. “During the hearing, the pornography industry paid lip service to protecting kids but argued for a standard that doesn’t allow for communities to protect children. In other words, they want a repeat of the last 20 years—which has failed children.”

A ruling is expected by summer. Already, 19 other states have implemented laws with online pornography age restrictions.

The Billy Graham Evangelist Association (BGEA), responding to a mother concerned by the culture’s acceptance and promotion of pornography to young people, wrote:

Pornography is both a symptom and a cause of the widespread immorality and corruption of modern society. It reaches people of all age levels through a multibillion-dollar industry including books, magazines, television, and movies, available at home and in hotels. In recent years, pornography has grown through the internet and is easily accessible through mobile devices so that it’s available with a tap on a screen. Respect and self-esteem plunge while guilt escalates. For some users, pornography leads to deviant sexual behavior and crimes.

Pornography is basically described as visual images, writing, or speech that is used for the purpose of arousing lustful sexual desires. The term derives from two Greek words: porne (“prostitute”) and graphein (“to write”). Pornographic material comes in many forms that penetrate thoughts and disturbs emotions. The saddest realization is that mankind feeds these evil desires most often through various entertainments. It will manifest itself in many ways. People may try to hide their secret life, but the Bible says, “Be sure your sin will find you out” (Numbers 32:23). Do not fulfill the lust of the flesh (see Romans 13:14).

“For all that is in the world—the lust of the flesh, the lust of the eyes…—is not of the Father but is of the world” (1 John 2:16). “Therefore do not let sin reign in your mortal body, that you should obey it in its lusts” (Romans 6:12). Flee from lust and pursue righteousness (see 2 Timothy 2:22), which can be found as one submits to Christ’s lordship by saturating our minds with the things of God.

The New England colonies, as well as New Jersey, Pennsylvania, and Maryland, were all founded by settlers who crossed the Atlantic Ocean to flee religious persecution in Great Britain and build a society firmly established on the Word of God. Even as the dawn of American exceptionalism—rooted in Biblical values—gave birth to the Declaration of Independence in 1776, the struggle raged on. Why did these fledgling colonists prevail in the American Revolutionary War against an English monarchy that had existed for more than 700 years? Because America’s Founding Fathers recognized God as the guarantor of our most precious rights.

Jan Markell: You Can’t Have A Genuine Revival With False Doctrine Raging

I hear a dozen evangelists stating that we are on the verge of a great revival. One self-proclaimed prophet says that a billion souls will come to faith in the coming weeks and months. If my Rapture is imminent, how can there be an imminent revival? Which is it? The Bible does talk about a coming revival. The question concerns its timing. Is it in the coming days, or is it after the Rapture when the “left behind” world realizes they should have listened to believers like you and me, get a second chance, and multitudes come to faith?
